Charges Dismissed Against Elder Wagner Family Member

The charges against one of the six members of a southern Ohio family charged in connection to the Rhoden family murders have been dismissed.

Fredericka Wagner, who was charged with obstruction and perjury, was in court on Wednesday for a pre-trial hearing.

Pike County Common Pleas Judge Randy Deering dismissed the charges without prejudice following a request from the prosecution.

The dismissal will allow the prosecution to analyze new evidence in the case, received by the defense in mid-March, without the allotted time limit for a speedy trial to lapse. Wagner had been scheduled to go to trial on July 29th, but the limitations on time for holding the trial were set to expire on August 3rd.

There is a six-year statute of limitations in the case and the prosecution says it plans to re-file the charges.

Wagner is accused of lying during her grand jury testimony in July of last year in regard to the purchase of two bullet proof vests.
